Terms and Condition

MNC Bank has drafted these Terms and Conditions to explain to the Customer the terms and conditions for using MotionBank services. We expect the Customer to read and understand every provision written in the Terms and Conditions and the Privacy Policy, which can be accessed via the following link: https://motionbank.id/kebijakan-privasi-id/, before using MotionBank services.

 

A. DEFINITIONS

  1. MotionBank is an electronic banking service provided by the Bank to Customers to perform financial and non-financial transactions with a clearer menu display, where the application must first be downloaded using a mobile phone device and Cellular Network, utilizing 2FA (two-factor authentication) in accordance with applicable standards and regulations.

  2. Bank or MNC Bank refers to PT Bank MNC Internasional Tbk, licensed and supervised by the Financial Services Authority (OJK), headquartered in Central Jakarta, with branch offices spread across the territory of the Republic of Indonesia.

  3. Personal Data refers to data, information, and/or descriptions of the Customer as defined in the Privacy Policy.

  4. Cellular Network is the data packet transmission and reception technology provided by cellular network/telecommunication service providers.

  5. Customer means parties who hold an Account or banking facilities at the Bank.

  6. Passcode is a secret identity or code owned and used by the Customer to log in to the MotionBank application.

  7. Personal Identification Number or PIN is a private identification number consisting of a series of numbers and/or letters obtained from the Bank or at the Customer's request, which is confidential and personal. The PIN serves as the Customer’s identity used to conduct financial banking transactions.

  8. One-Time Password (OTP) is a code generated by the MotionBank system used during transactions, which can only be used once within a limited validity period.

  9. Account refers to checking accounts, savings accounts, time deposits, and/or other types of accounts owned by the Customer at the Bank that are linked to MotionBank.

  10. Instruction is a command given by the Customer to the Bank through MotionBank in accordance with the Bank’s procedures and provisions.

  11. MNC Bank Credit Card is a payment instrument in the form of a credit card issued by MNC Bank, including Visa Gold, Visa Platinum, MasterCard MotionBank, or other types of credit cards issued by MNC Bank.

  12. MNC Bank Debit Card is a payment instrument in the form of a debit card issued by MNC Bank, including MasterCard, GPN, or other types of debit cards issued by MNC Bank.

  13. Privacy and Security Policy – MotionBank (hereinafter referred to as the “Privacy Policy”) is the policy explaining the management of Personal Data by the Bank, which constitutes an inseparable and integral part of these Terms and Conditions.

  14. KTA or Unsecured Credit (Kredit Tanpa Agunan) is the provision of credit facilities by the Bank to a debtor without any collateral provided by the debtor to guarantee said credit facility.

  15. Interest Rate is the percentage of interest used in the calculation of interest for savings, time deposits, or credit facilities from the Bank to the Customer.

  16. MotionBank Terms and Conditions (hereinafter referred to as the “Terms and Conditions”) are these MotionBank terms and conditions, which may be amended from time to time by the Bank with prior notice to the Customer.

  17. Quick Response Code or QR Code is a two-dimensional code consisting of three square pattern markers at the bottom-left, top-left, and top-right corners, featuring black modules in the form of square dots or pixels, and possessing the capability to store alphanumeric data, characters, and symbols.

  18. Quick Response Code Indonesia Standard (QRIS) is a payment system using QR Codes initiated by Bank Indonesia, where the source of funds for QRIS users originates from an Account.

  19. QRIS Transaction is a payment transaction facilitated by a payment QR Code based on QRIS.

  20. Tabmotion is a savings product that can be created exclusively through MotionBank.

   

B. TERMS AND CONDITIONS

  1. MotionBank is an integrated service for every individual Account.

  2. MotionBank can be activated after the Customer registers and creates a Passcode and PIN during their first access to MotionBank.

  3. A Customer may open up to a maximum of 10 (ten) TabMotion Accounts under 1 (one) Customer Identification File (CIF).

  4. The minimum initial deposit required for opening a TabMotion account is Rp100,000 (one hundred thousand Rupiah).

  5. MotionBank registration can also be completed using an MNC Bank Debit Card or MNC Bank Credit Card.

  6. Transactions in MotionBank can only be processed if the Customer uses the correct PIN or OTP.

  7. MotionBank can only be used for 1 (one) Customer Identification File (CIF) number and on 1 (one) mobile device to download the application.

  8. The results of the simulation services for time deposits and KTA (if any) with a flat annual Interest Rate are not the final values to be received or paid by the Customer.

  9. Customers may activate the biometric login feature using fingerprint or facial recognition based on the biometric features available on the mobile phone used by the Customer.

  10. The Customer acknowledges that biometric authentication (fingerprint or facial recognition) can be used as an authentication option, including for displaying the CVV and expiry date information of the MNC Bank Credit Card.

  11. The Customer is responsible for the security of all fingerprints or facial recognition profiles registered/recorded/stored on the Customer’s mobile device.

  12. To comply with applicable laws and regulations and for the purpose of verifying the Customer’s identity during account opening via MotionBank, the Bank collaborates with PT Indonesia Digital Identity (“VIDA”) as a partner to verify Personal Data (demographic and/or biometric data) against data recorded in the system of the identity-issuing authority. If the Personal Data is verified as accurate, VIDA—as an electronic certification provider recognized by the Ministry of Communication and Informatics of the Republic of Indonesia—will issue an electronic certificate as proof of verification. VIDA's Certificate Policy and/or Certificate Practice Statement can be accessed at https://repo.vida.id. In this regard, the Customer acknowledges the risk of Personal Data leakage by third parties.

  13. Instructions given by the Customer through MotionBank can only be carried out using the mobile phone number registered with the Bank after the Customer has activated MotionBank. The Customer is obliged to ensure the authenticity and validity of the mobile phone number, Passcode, PIN, and/or transaction codes, as well as the accuracy and completeness of the Instruction. Such Instructions are valid and legally binding on both the Customer and the Bank.

  14. Proof of transaction will be displayed once the MotionBank system deems all authorization processes successful.

  15. The Customer must ensure and is responsible for the accuracy and completeness of transaction orders (including ensuring all required data is entered correctly and accurately).

  16. The Customer must ensure that the Account balance is sufficient before a transaction Instruction is executed through MotionBank.

  17. Any transaction instructed to the Bank and approved by the Customer cannot be canceled.

  18. For every financial transaction, the system will always confirm the data entered (input) by the Customer, and the Customer has the opportunity to cancel by clicking the "Cancel" button. To signify approval of the displayed transaction data, the Customer must press the "Continue" button on the financial transaction confirmation menu.

  19. The Bank reserves the right not to execute a Customer's order if:

a. The Customer's account balance is insufficient;

b. The Customer's account is blocked/closed or based on the Bank's discretion (which will be notified to the Customer);

c. The Bank knows or has reason to suspect fraudulent practices, criminal acts, or violations of laws and regulations;

d. There is a lack of requirements needed by the Bank to process the request or Instruction;

e. Based on the Bank's reasons and considerations to protect the Customer's interests.

  1. Customers are prohibited from manipulating, copying data, and/or taking other actions that result in unlawful changes to data on MotionBank or the mobile phone number data on the SIM card registered with MotionBank.

  2. The Customer must immediately report to the Bank if:

a. They no longer use the mobile phone number registered with MotionBank;

b. They discover indications of SIM card duplication;

c. There is unauthorized use and/or modification of MotionBank by an unauthorized party.

The Customer is responsible for all consequences and/or losses arising from their negligence in reporting the aforementioned matters.

  1. The Bank reserves the right to temporarily suspend MotionBank services for a period determined by the Bank for updates, maintenance, or other purposes deemed necessary, and the Bank will notify the Customer of such suspension.

  2. MotionBank content is provided as general information and cannot be used as a basis for specific investment, business, or commercial decisions.

  3. If the Customer conducts a QRIS Transaction through MotionBank:

a. The QRIS Transaction limit per transaction follows the limit set by Bank Indonesia, while the daily cumulative limit refers to the fees and limits info page in the additional information menu of MotionBank;

b. The Customer must ensure the accuracy of the merchant name and the QRIS Transaction amount. The Customer is fully responsible for all consequences arising from the transaction, including losses due to negligence in verifying details;

c. By conducting a QRIS Transaction, the Customer agrees that the Bank has the right to provide the Customer's name and mobile phone number to the recipient of the funds for identification purposes.

 

 

C. PASSCODE, PIN, AND OTP

  1. Passcode, PIN, and OTP are confidential codes, and the authority for their use rests with the Customer. The Customer is responsible for properly safeguarding these codes.

  2. Customers are permitted to create their own Passcode and PIN and may change or replace them if there is any indication that the codes have become known to another party.

  3. A Customer's MotionBank Passcode, PIN, and OTP will be blocked in the following circumstances:

a. The Customer enters the incorrect Passcode three (3) consecutive times during login;

b. At the request of the Customer;

c. If the Customer suspects or knows that the codes have been compromised by an unauthorized party and reports it for blocking.

  1. In the event of a block, the Customer should:

a. Re-register for MotionBank; or

b. Reset the password by contacting the MNC Bank Call Center at 1500188 or visiting the nearest branch.

  1. Customers must secure their MotionBank access codes by:

a. Not disclosing codes to any other party;

b. Not recording codes on paper or any other storage media accessible to others;

c. Using codes cautiously to prevent observation;

d. Changing the Passcode and PIN periodically;

e. Avoiding easily guessed codes such as birth dates, telephone numbers, or combinations thereof.

  1. The Customer is responsible for any consequences arising from the misuse of the Passcode, PIN, and OTP, whether due to intentional acts or the Customer's negligence in storing or using said Passcode, PIN, and OTP.

  2. The use of a Passcode, PIN, biometric verification, OTP verification, and/or other identification media on MotionBank has the same legal force as a written order signed by the Customer, including but not limited to the debiting of the Customer's account, whether for the execution of an instructed transaction or for the payment of transaction fees.

  3. Customers are required to enter a Passcode to gain access to MotionBank services. To ensure protection when accessing MotionBank, Customers are requested to do the following:

a. When entering an MNC Bank Debit Card / MNC Bank Credit Card number for the first time, MNC Bank advises against using information that is easily guessed, such as dates of birth, vehicle registration numbers, phone numbers, and so on. If a Customer feels that their Passcode and/or Personal Identification Number (“PIN”) has been disclosed to or discovered by a third party, lost, or stolen, and that an unauthorized transaction may have occurred, the Customer is responsible for reporting it immediately to MNC Bank;

b. To protect Customer access and transactions when using MotionBank services, MNC Bank employs the following security systems:

1) Secure Socket Layer (“SSL”) is a security technology that "scrambles" communication paths between computers so they cannot be read by other parties. MNC Bank’s network (web) security area utilizes 256-bit SSL encryption technology to protect communications between the Customer's gadget/device and the MNC Bank server while accessing MotionBank services;Passcode and PIN;One-Time Password (OTP) is a security technology that consistently generates a different password each time it is used for a specific transaction (specifically for iPhone users);

2) Passcode and PIN;

3) One-Time Password (OTP) is a security technology that consistently generates a different password each time it is used for a specific transaction (specifically for iPhone users).

  1. To enhance security for the Customer, a time-out session method is employed; if there is no Customer activity for a period of 5 (five) minutes, the access will automatically log out or disconnect.

  2. To use MotionBank services at this time, the recommended minimum mobile phone operating system specifications are: (i) for Android OS: 4.1; and (ii) for iOS: 6.0. MNC Bank reserves the right to change the specifications required to use MotionBank services, with prior notice to the Customer in accordance with applicable regulations..

 

D. BLOCKING AND/OR TERMINATION OF MOTIONBANK SERVICES

Customers may provide instructions to the Bank to block MotionBank through the MNC Bank Call Center at 1500188 and/or the nearest Bank branch.

If the Customer's mobile phone and/or SIM card is lost, stolen, duplicated, or transferred to another party, the Customer is obliged to immediately block the mobile phone number through their telecommunications service provider and notify the Bank via the MNC Bank Call Center or the nearest branch to block MotionBank. Until such notification is received by an authorized Bank official, all instructions, transactions, and communications conducted by unauthorized parties using the MotionBank Passcode, PIN, and OTP shall remain the responsibility of the Customer.

Requests to unblock and/or terminate MotionBank by the Customer can be made at a Bank branch by submitting a written request to the Bank or in accordance with the procedures established by the Bank.

A Customer's MotionBank account may be suspended and/or terminated by the Bank if:

a. A change occurs in the mobile phone number used by the Customer, and the Bank has been notified of such change;

b. The Customer closes the Account(s) accessible through MotionBank;

c. It is required by prevailing laws and regulations and/or a court order;

d. The Bank discovers misuse of the Account by the Customer or another third party in connection with a violation of the law;

e. The Bank experiences a disruption and ceases the provision of MotionBank services by providing notice to the Customer through media determined by the Bank.

 

E. FEES AND CHARGES

  1. The Bank reserves the right to debit monthly administrative fees and/or transaction fees charged for the use of MotionBank and/or transactions conducted through MotionBank, including but not limited to transaction fees, transfer fees, bill payment fees, and other charges. Provisions regarding these fees can be viewed in the additional information menu within MotionBank or through the Bank's communication media.

  2. The Customer hereby authorizes the Bank to debit the Customer's Account for the payment of fees related to the use of MotionBank.

  3. The Customer shall also bear the data and/or internet network costs used at the rates determined by their telecommunications service provider.

 

F. POWER OF ATTORNEY / AUTHORIZATION

The power of attorney granted by the Customer to the Bank in accordance with these Terms and Conditions is irrevocable, cannot be revoked, and/or shall not terminate due to the reasons set forth in Article 1813 (termination of power of attorney due to withdrawal or termination of power, death, guardianship, or bankruptcy of the grantor or grantee), Article 1814 (revocation of power of attorney), and Article 1816 (appointment of a new grantee) of the Civil Code or for any other reason, and this power of attorney constitutes an integral and inseparable part of these Terms and Conditions.

 

G. CURRENCY EXCHANGE RATE INFORMATION

The exchange rate data listed in MotionBank is accurate and intended for informational purposes only; it does not serve as the basis or reference for executing transactions. The data used to conduct a transaction is the exchange rate prevailing at the time the transaction is processed. The Bank may, at any time, update the existing data based on current applicable exchange rates.

 

H. RESPONSIBILITIES OF THE MOTIONBANK CUSTOMER

  1. The Customer is obliged to ensure that the mobile phone and network used to conduct transactions through MotionBank are free from viruses, malware, or any other elements that may interfere with and/or prevent the execution of the Customer's transactions.

  2. The Customer is responsible for the security of the mobile phone used as the medium to access MotionBank by performing adequate maintenance and storage to prevent failures, misuse, violations, and/or crimes by irresponsible third parties against MotionBank.

  3. All consequences arising as a result of the misuse and/or violation of MotionBank usage (including the Passcode, PIN, and OTP) are the sole responsibility of the Customer, including but not limited to the following:

a. Transactions conducted by the Customer that violate or conflict with these Terms and Conditions and/or applicable laws, regulations, and/or Bank policies;

b. The disclosure and misuse of the Customer's Passcode and/or PIN by another party;

c. Incomplete or incorrect Instructions and any transactions caused by the Customer's negligence and/or error that result in a risk of loss to the Customer.

 

I. EVIDENCE

  1. The Customer understands that by conducting transactions through MotionBank, the Customer acknowledges that all instructions and communications from the Customer received by the Bank shall be treated as valid evidence, even if no written document is created and/or no document signed by the Customer is issued.

  2. Proof of instructions from the Customer to the Bank and all forms of communication between the Bank and the Customer sent electronically—stored in the Bank's data center or via other means of communication received or sent by the Bank and stored in the form of information storage and other data at the Bank, whether in the form of written documents, records, tapes/cartridges, computer printouts, and/or copies—constitute valid evidence.

  3. The Bank's bookkeeping and/or records, whether in the form of documents, electronic media, or other documentation (including but not limited to withdrawal media, letters, and other documents) stored and maintained by the Bank, constitute valid and binding evidence for the parties involved.

  4. The Customer acknowledges that all instructions from the Customer received by the Bank will be treated as valid evidence, even if they are not produced in the form of a written document or issued as a signed document.

 

J. INTELLECTUAL PROPERTY RIGHTS

  1. Copyrights, patents, trade secrets, trademarks, images, logos, and all other intellectual property rights within MotionBank and its content are owned by the Bank.

  2. No part of these Terms and Conditions may be used, downloaded, reproduced, distributed, published, modified, displayed, broadcasted, hyperlinked, or transmitted in any way or by any means, or stored in an information retrieval system, without prior written permission from the Bank.

 

K. FORCE MAJEURE

  1. The Bank may not execute the Customer's instructions, either in part or in their entirety, due to events or causes beyond the Bank's power or capability occurring within MotionBank (or any part thereof). This includes, but is not limited to, any interference from computer viruses, Trojan horse systems, or harmful components that may disrupt MotionBank, the web browser, the Bank's computer systems, or internet service providers, as well as natural disasters, wars, riots, malfunctioning equipment, systems or transmissions, power outages, telecommunication disruptions, government policies, and other events or causes beyond the Bank's power or capability.

  2. Specifically regarding fund transfer transactions that cannot be executed by the Bank upon the Customer's request due to the events mentioned in point 1 above, the Bank shall notify the Customer of such occurrences and shall execute the fund transfer Instructions no later than the timeframe stipulated by the prevailing laws and regulations.

 

L. DOCUMENTATION AND DELIVERY OF INFORMATION/PROMOTIONS

  1. With prior notice to the Customer through media or means in accordance with prevailing laws and regulations, the Bank reserves the right to:

a. limit, reduce, modify, cancel, and/or terminate all or part of the services available on MotionBank; and/or

b. add, reduce, withdraw, or modify the types of transactions currently available or those that can be performed through MotionBank.

  1. The Bank reserves the right to deliver offers and/or information regarding products and services from the Bank or its affiliates through appropriate electronic and/or written means in accordance with prevailing laws and regulations, whether via MotionBank, branch offices, or the Bank's website, as a form of promotion.

 

M. RIGHT TO MAKE CORRECTIONS

  1. The Bank reserves the right to perform corrections to the Account balance on MotionBank and/or transactions on the Customer's Account if, according to the Bank's records, an irregular transaction has occurred or is reasonably suspected to have occurred. Such corrections include the Bank’s reasonable discretion and belief to withhold part or all of the balance and to withdraw funds from the Customer's Account in connection with or caused by fraud, embezzlement, misuse, and/or other unlawful acts.

  2. In the event that a correction is made due to the Bank's internal error, the Bank will inform the Customer accordingly. If a refund is required, the Bank grants the Customer the right to submit a claim through: (i) the Bank’s Official WhatsApp: +62 888-8888-888; (ii) the Bank’s Call Center: 1500 188; (iii) email: cs@motionbank.id; or (iv) by visiting the nearest Bank branch office.

 

N. GOVERNING LAW AND DISPUTE RESOLUTION

  1. These Terms and Conditions are drafted, interpreted, and governed in accordance with the laws of the Republic of Indonesia.

  2. Any dispute arising under or based on these Terms and Conditions shall be resolved in the following manner:

a. Any dispute or difference of opinion arising from and/or relating to the implementation of these Terms and Conditions shall, as far as possible, be resolved through deliberation to reach a consensus;

b. Any dispute or difference of opinion that cannot be resolved through deliberation by the parties shall be settled through an Alternative Dispute Resolution Agency included in the List of Alternative Dispute Resolution Agencies established by the Financial Services Authority (OJK);

c. Any dispute or difference of opinion that cannot be resolved through deliberation and/or the Alternative Dispute Resolution Agency listed by the Financial Services Authority (OJK) shall be settled through the Central Jakarta District Court within the territory of the Republic of Indonesia, without prejudice to the Bank's right to file a lawsuit through other District Courts within the Republic of Indonesia (non-exclusive jurisdiction).

 

O. HANDLING OF COMPLAINTS

  1. For any issues related to transactions and access to MotionBank, or if there are any questions or matters that require clarification, the Customer may contact the MNC Bank Call Center at 1500-188 or send an email to: cs@motionbank.id.

  2. In the event that a complaint is submitted in writing, the Customer is required to attach photocopies or evidence of the transaction and other supporting documents.

  3. The Bank may conduct an examination or investigation into the Customer's complaint in accordance with the prevailing regulations at the Bank.

 

P. AMENDMENT OF TERMS AND CONDITIONS

  1. The Customer understands that these Terms and Conditions may be amended by the Bank from time to time and will be notified to the Customer no later than 30 (thirty) working days prior to the effective date of such changes, additions, and/or adjustments to these Terms and Conditions.

  2. If, during the aforementioned notice period, the Customer does not object to the changes, additions, and/or adjustments to these Terms and Conditions, the Customer shall be deemed to have agreed to them. However, if the Customer does not agree, the Customer has the right to terminate the use of MotionBank in accordance with these Terms and Conditions after fulfilling all outstanding obligations to the Bank.

  3. Any notification from the Bank will be delivered in writing or verbally to the Customer's address recorded in the Bank's data. Such Bank notifications may also be posted in writing on announcement boards at each of the Bank's branch offices, or through print media, electronic media, or other media. The delivery of these notifications refers to the prevailing laws and regulations.

 

Q. MISCELLANEOUS

  1. The Bank may enter into partnerships with third parties to market the products and services of said third parties to the extent permitted under applicable laws and regulations. The Bank is not responsible for the content, form, type, risks, and/or availability of third-party products and services, nor for any other matters related to such products and services, which remain the sole responsibility of the third party.

  2. The Customer hereby acknowledges that the MotionBank application, as well as third-party services and/or applications, may or can experience restrictions, delays, and/or other issues, including those caused by or in connection with: (a) the unavailability or limitation of networks (including the internet); or (b) the unavailability, disruption, or malfunction of certain features on the device used by the Customer.

  3. The Customer is responsible for any claims from any party as well as for the Customer's own losses resulting from or in connection with the Customer's intentional acts or negligence, whether in the form of:

a. loss of income, profit, or other earnings;

b. loss, damage, or injury arising from, or in connection with the use of MotionBank and/or services due to the Customer's inability or error in using MotionBank and/or services; or

c. claims or lawsuits faced by the Customer that may arise as a result of the submission of incomplete information by the Customer or as a result of the non-execution of the Customer's Instructions, including the cancellation or modification of Instructions (for Instructions that have not yet been executed) submitted to the Bank.

  1. Customers are encouraged to read the Privacy Policy, which explains the collection, use, and protection of non-public personal information and will help the Customer understand how the Bank maintains and treats the information it receives. The Privacy Policy constitutes an integral and inseparable part of these Terms and Conditions..

  2. The Customer shall comply with the prevailing laws and regulations, particularly in the financial services sector, as well as these Terms and Conditions.

  3. These Terms and Conditions have been harmonized with the prevailing laws and regulations, including the regulatory provisions of the Financial Services Authority (OJK).
